Overview
Jason P. Wapiennik, PLC (“we,” “us,” or “our”) offers SMS/text messaging programs (“SMS Program”) to communicate with clients and prospective clients. These SMS Terms & Conditions (“SMS Terms”) govern your participation.
Opt-In & Consent
By opting in (e.g., checking a box, signing a form, texting a keyword to a short code/long code, or requesting updates via intake), you agree to receive recurring text messages from us related to:
- Appointment confirmations and reminders
- Case updates and scheduling coordination
- Requested information, document prompts, and notices
- Marketing or educational messages (only if separately consented)
Message frequency varies by matter and subscription. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Eligibility
You must be the account holder or have permission from the account holder to provide a mobile number and enroll in the SMS Program.
Opt-Out / Unsubscribe
You may opt out at any time by replying STOP to any message. After we process your STOP request, you will receive a one-time confirmation message and no further messages will be sent unless you re‑opt‑in.

Updating Your Information
You agree to keep your contact information accurate and up to date. If your number changes, please notify us immediately.
Confidentiality & Attorney–Client Communications
We may use SMS for administrative and scheduling purposes. While we take reasonable safeguards, SMS is not a secure channel. To protect confidentiality, do not send sensitive details via SMS. Substantive legal advice and confidential materials should be exchanged via secure channels (e.g., encrypted client portal, phone, or in‑person).
Attorney–client relationship: Receiving texts from us does not create an attorney–client relationship unless separately and formally established by engagement letter or written agreement.
User Responsibilities
You agree not to use our SMS Program for unlawful, abusive, harassing, or disruptive purposes. You represent that you own or have authority to use the enrolled mobile number.
Program Changes & Termination
We may modify, suspend, or terminate the SMS Program at any time. We will endeavor to notify you of material changes where required.
Dispute Resolution
Any disputes arising from or related to these SMS Terms or the SMS Program shall be governed by Michigan law and resolved per the dispute resolution clause in our general Terms of Service/Engagement Agreement, if applicable.
Privacy
We handle personal information per our Privacy Policy (below). By participating, you acknowledge and consent to our data practices, including collection, use, and retention related to SMS.
